SALT LAKE CITY (AP) A judge has dismissed a lawsuit from opponents of Common Core who that argued the state illegally took a backdoor approach to adopting the education standards.

Judge Paige Petersen ruled Tuesday that she couldn't consider the case because the plaintiffs didn't take up the issue with the Utah State Board of Education before they sued.

Petersen ruled in favor of state education officials who say they followed the rules for adopting the benchmarks in 2010, but she left the door open for the case to be filed again.

Connor Boyack, president of the Libertas Institute, says he expects the issue to come back to court.
