(KUTV) -- FanX is filed an emergency appeal with the 9th Circuit Court of Appeals for an emergency stay in their lawsuit over the Comic Con name.

A district court judge initially ordered the Salt Lake City-based convention to pay San Diego Comic Con $4 million for illegally using the Comic Con name.

In the new court filings, FanX is asking the appeals court to put the judgment on hold.

Fanx claims that paying the fee would cause them to go bankrupt.
